Please read these Terms and Conditions ("Terms") carefully before using the PotMagic platform (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
PotMagic provides an online storytelling platform for artists and creators. By creating an account or using the Service, you agree to comply with and be bound by these Terms and our Privacy Policy.
2. Nature of Service
PotMagic is currently a non-commercial platform. The Service is provided as a tool for artists, directors, and performers to facilitate live online storytelling.
- Commercial Status: We reserve the right to change the status of the Service from non-commercial to commercial at any time. Users will be notified of any significant changes to the fee structure or commercial usage rights.
3. Technical Limitations and Live Streaming
- WebRTC Technology: The Service utilizes WebRTC technology for live streaming.
- Broadcast Quality: PotMagic is a platform provider only. We are not responsible for the quality of the audio or video broadcast. The quality of the stream is entirely dependent on the user’s local hardware and internet connection strength.
- Service Continuity: We do not guarantee uninterrupted service and are not liable for "lag," dropped connections, or technical glitches during a live performance.
4. User Responsibilities
Invitations
When a user (Director) invites actors or viewers to a session, it is the user’s sole responsibility to ensure the correct email addresses are entered. PotMagic is not responsible for invitations sent to the wrong recipients or unauthorized access resulting from user error.
Local Recording
The platform allows Directors to record performances. These videos are saved directly to the user’s local hard drive.
- PotMagic does not store these recordings on its servers.
- It is the Director's responsibility to manually start and stop the recording.
- PotMagic is not liable for lost data, failure to record, or technical failures of the recording button during a live show.
5. Content Standards and Conduct
We maintain a zero-tolerance policy for illegal or harmful content.
- Prohibited Content: The broadcast or upload of any obscene, indecent, or sexually explicit images/videos is strictly prohibited.
- Abuse: Any form of harassment, hate speech, or abuse directed at other users or using the app for unintended malicious purposes is forbidden.
- Moderation: We reserve the right to remove any content that violates these standards.
- Account Termination: Violation of these conduct rules will lead to immediate account suspension or permanent removal of the user from the platform without prior notice.
6. Intellectual Property
- User Content: Users retain ownership of the stories and performances created on the platform. However, by using the platform, you grant PotMagic a limited license to facilitate the broadcast of your content.
- Platform Rights: All software, design, and branding associated with PotMagic remain the exclusive property of the developers.
7. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE." PotMagic makes no warranties, expressed or implied, regarding the reliability or fitness of the platform for a particular purpose.
8. Limitation of Liability
To the maximum extent permitted by law, PotMagic and its developers shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Service, including but not limited to loss of recordings or failed broadcasts.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the new Terms.
